The Medical POA (and why YOU need one)

The Medical Power of Attorney - POA

(and why every veteran needs one)

Planning for the future isn’t just about finances. It’s also about ensuring your health care wishes are respected if you’re ever unable to speak for yourself. One of the most important tools Veterans and their families can use is a Medical Power of Attorney (POA).

A Medical Power of Attorney allows a Veteran to legally designate a trusted individual to make health care decisions on their behalf if they become incapacitated. This person, often a spouse, family member, or close friend, can ensure medical decisions align with the Veteran’s personal wishes, including religious and moral beliefs. For families, having a Medical POA in place removes uncertainty and helps prevent confusion during already stressful situations.

Without a Medical POA, Texas state law determines who is allowed to make medical decisions for a Veteran. While this may work in some cases, it doesn’t always reflect a Veteran’s personal preferences or family dynamics. Establishing a POA ensures you stay in control of your care, even when you cannot communicate those decisions yourself.

Why a Medical POA Matters for Veterans

If a Veteran becomes unable to make their own health care decisions and does not have a Medical Power of Attorney, Texas law assigns decision-making authority in the following order:

  1. Spouse

  2. Adult children

  3. Parents

  4. Nearest living relative

While these individuals may have the best intentions, this process can lead to disagreements, delays in care, or decisions that don’t fully reflect the Veteran’s wishes. A Medical POA removes doubt, provides clarity, and gives families peace of mind.
